I have written a piece for the Constitutional Law and Philosophy blog on the recent SIR judgement. My analysis takes up the Supreme Court's conclusion that the ECI may scrutinise citizenship status for the purposes of electoral eligibility. I argue that the Court's reasoning travels only so far as its express premises permit; beyond that, it generates tensions and contradictions that the judgement fails to resolve. I also highlight the extent to which the Court's analysis rests upon a rather selective memory of the past and lived experience. The title, borrowed from Michel Gondry's 2004 film, reflects that theme.
